b. There is no time limit which would restrict the number of minutes in which the Parliament can consider and act on recommendations of the Finance Committee. The Supreme Court in its judgment that the CA should not be voided (xxx v. Maldives, xxx, at [51]) relied on the same reasoning to conclude that the CA may be voided without restrictions. The Supreme Court, in contradiction to the analysis in the CA Report, also held that when the Government decides to terminate the CA, the Government should specify the date as to which the CA would terminate and not simply providing vague term of “Once the Debtors performs all the payment,” which the Supreme Court construed to mean the date as of which it would no longer be a debtor under the CA.

h. In the CA Report, the Tender Evaluation Section of the MoFT had argued that the CA should not be terminated because of the convenience for the Government and the Debtors is owed to the MoFT an amount after the 7% discount has been taken from the sum of the concession fees which was due at the time the CA was signed. As to the Debtors, it was argued the Convention took into consideration that the agency would be solely in the hands of the Claimant and the Debtors would not be able to change their organization during the implementation of the project. As to the Government, it was argued that the newly formed Cabinet at the time the CA was signed seemed to secure the recommendations of the Finance Committee and the Tender Evaluation Section with more vigour than the previous Cabinet that had given the Government any opposition to the CA arrangement.

i. Even though the Law Drafting Unit in MoFT had already submitted the draft of the CA to the Law Drafting Unit in MoET for the necessary amendments, including the insertion of a provision for the termination of the CA, the Tender Evaluation Section became unsure when the request to terminate the CA was accepted by the Law Drafting Unit in MoET.
